Duties and Responsibilities

The Bureau of Administrative Reviews (BAR) is dedicated to improving the safety of Florida's roadways, while at the same time providing excellent customer service and a fair and impartial due process for drivers whose driver license or driving privilege is suspended, revoked, canceled, or disqualified. As an Administrative Hearing Officer I, this position is responsible for conducting administrative review hearings under oath to make determinations for possible reinstatement of driver licenses in accordance with Florida Statutes and DHSMV policies and procedures. As an Administrative Hearing Officer, you will be responsible for managing a complex caseload that is subject to strict deadlines, researching case backgrounds, reviewing and evaluating testimony and evidence, and decision making in all tasks performed. This position is also responsible for issuing final orders and documenting decisions and outcomes of hearings.

Knowledge, Skills, and Abilities

  • Professionalism and Customer Service- must be able to conduct hearings in a professional and impartial manner, ensuring the integrity of the process and respect for all of the participating stakeholders; must be able to maintain high professional standards and remain calm, courteous, and tactful while dealing with situations that are sensitive in nature or with individuals who are difficult, hostile, or distressed.

  • Communication and Active Listening- must be able to express ideas and facts clearly verbally and in writing, to include conveying complex or detailed information to individuals with varying levels of understanding of the administrative hearing process; must be able to ensure that others fully comprehend the intended message, must be able to listen carefully to obtain needed information and effectively assist customers.

  • Attention to Detail- must be thorough and conscientious in accomplishing tasks, no matter how small, ensuring that work is done accurately according to procedures and standards.

  • Organization and Prioritization- must be able to plan and organize time, resources, and workload effectively in order to complete assignments in a timely manner and meet statutory deadlines.

  • Information Comprehension and Interpretation- must be able to understand, interpret and logically apply a variety of legal and non-legal information/data to cases under review. This includes driver history records, investigation reports, FLHSMV policies and procedures, administrative rules, and Florida statutes.

  • Reasoning, Critical Thinking, and Judgment- must be able to weigh and evaluate a variety of legal and non-legal information and consider numerous factors while making sound, well-informed, and objective decisions based on case information, testimony, evidence, and established laws and regulations.

  • Discretion and Integrity- must be able to handle sensitive information with discretion, maintain the confidentiality of information, and uphold the integrity of the administrative review process.

  • Technology Application- must be able to proficiently operate a computer and associated systems/applications such as Microsoft Office applications and possess the aptitude to learn new software.

Preferred Qualifications

  • At least two (2) years of customer service experience dealing with customer complaints, inquiries, and/or problem resolution.

  • At least one (1) year of experience composing and preparing written correspondence and reports.

  • Experience interpreting and applying rules, regulations, policies and procedures.

Job Related Requirements

  • The position you are applying is subject to a Level 2 background check, along with Criminal Justice Information System (CJIS) clearance, to include a fingerprint-based check of the criminal records of the FBI, as a condition of employment pursuant to Chapter 110.1127, 435 and 943, Florida Statutes. Please note that, since this position requires CJIS clearance, the Department will have access to all an applicant's criminal and juvenile delinquency records, even those that have been sealed or expunged.

  • High school diploma or equivalent (GED)

  • Occasional overnight travel

  • Completion of Hearing Officer Training (Phase I and II) within one (1) year of employment.

  • This position requires the incumbent to have and maintain a valid driver's license in good standing. A driver's license history review will be conducted on all candidates in consideration for the position.

General Information

  • The elements of the selection process may include a skill assessment and/or oral interview.

  • Applicants being considered for employment will be required to submit to a fingerprint-based background investigation, which will include a check of the criminal history records of the FBI. Fingerprints and associated information/biometrics will be retained in the FBI's Next Generation Identification (NGI) system and fingerprints may continue to be compared against fingerprints submitted to or retained by NGI.

  • FLHSMV employees are paid once a month on the last workday of each month. All state employees are required to participate in the direct deposit program pursuant to s. 110.113 Florida Statutes.
